Aelis User Agreement

Aelis is a mobile application that allows users to create personalized portrait check-in photos in various scenarios (e.g., cafes, parks, bookstores, streets) by selecting corresponding atmosphere tags (e.g., lazy, healing, literary, trendy) and using AI technology to seamlessly integrate portraits into selected scenes. This User Agreement ("Agreement") governs your use of the Aelis application and all related services provided by Aelis ("Service").

By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the Service.

To use certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to:

• Provide accurate, current, and complete information when creating your account.
• Update your account information to keep it accurate, current, and complete.
• Not share your account credentials with any third party.
• Notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account if we believe you have violated this Agreement or applicable laws.

You agree to use the Service only for lawful purposes and in accordance with this Agreement. You are prohibited from:

• Using the Service to infringe on the intellectual property rights, privacy rights, or other legal rights of any third party.
• Uploading, sharing, or distributing content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Attempting to interfere with the operation of the Service or the servers or networks connected to the Service.
• Using the Service to impersonate any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Using the Service for any commercial purpose without our prior written consent.

You retain all rights to the content you create, upload, or share through the Service ("User Content"). By providing User Content to the Service, you grant Aelis a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the Service.

You represent and warrant that you have all necessary rights, licenses, consents, and permissions to grant the above license and that your User Content does not infringe on the rights of any third party.

Aelis reserves the right to remove any User Content that violates this Agreement or applicable laws at our sole discretion.

Certain features of the Service may be available only through a paid subscription or one-time purchase. All payments are non-refundable unless explicitly stated otherwise. You agree to:

• Pay all fees and charges incurred in connection with your use of the Service.
• Authorize us to charge your chosen payment method for all such fees and charges.
• Provide accurate and complete payment information.
• Update your payment information to keep it accurate, current, and complete.

We reserve the right to change our pricing at any time. We will provide you with notice of any pricing changes before they take effect.

Aelis reserves the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may terminate this Agreement and your access to the Service immediately, without prior notice or liability, if you breach any of the terms of this Agreement. Upon termination, your right to use the Service will immediately cease.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AELIS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AELIS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS IN THE SERVICE WILL BE CORRECTED.

IN NO EVENT SHALL AELIS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

Any dispute arising out of or in connection with this Agreement shall be resolved through good faith negotiations between you and Aelis. If the dispute cannot be resolved through negotiations, it shall be submitted to arbitration in accordance with the rules of the [Arbitration Association]. The arbitration shall be conducted in [City, State], and the language of the arbitration shall be English.

Aelis may update this Agreement from time to time. We will notify you of any changes by posting the new Agreement on the Service. You are advised to review this Agreement periodically for any changes. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Agreement.
